Help out, raise funds, make the world a better place.<\/p>\n\n\n\n<p>If only it were that simple. In fact, there\u2019s a world of difference in how third-sector organisations are set up, structured, and run.<\/p>\n\n\n\n<p>And \u2013 unsurprisingly, given you\u2019re here \u2013 those differences extend to the risks they face when doing all that good work.<\/p>\n\n\n\n<p>But let\u2019s look at those differences, as well as the similarities, between charities and social enterprises in more detail.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The power of good<\/h2>\n\n\n\n<p>A charity, social enterprise, or non-profit can have the same mission: let\u2019s say for the sake of argument here, that it\u2019s to help the homeless.<\/p>\n\n\n\n<p>Exactly how they go about fulfilling that mission is what separates Adam from Eve.<\/p>\n\n\n\n<p>A charity may raise money by applying for government grants and running fundraisers. They\u2019ll then use that money to help others e.g. by investing in employment support programmes for the homeless. <\/p>\n\n\n\n<p>A social enterprise acts like a business \u2013 one with an ethical twist. For example, a social enterprise might run a chain of cafes staffed by homeless people. Most of their revenue will be invested back into their business. The rest might be donated to a homeless charity.<\/p>\n\n\n\n<p>A not-for-profit is a catch-all term for an organisation that has charitable aims but doesn\u2019t privately profit any one individual or board. It\u2019s a harder term to pin down as it can include many different types of organisations, including social enterprises.<\/p>\n\n\n\n<p>What a not-for-profit isn\u2019t, though, is a legal structure in itself. And structure is important\u2026it sets out the framework for how charities and social enterprises can operate. We\u2019ll look at exactly what that means next.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The differences between charities and social enterprises<\/h2>\n\n\n\n<p>Because charities and social enterprises are run differently, the guidelines for setting them up are different. They\u2019re also differently regulated and taxed.<\/p>\n\n\n\n<p><strong>Registration<\/strong><\/p>\n\n\n\n<p>Legally, all charities in England and Wales must be registered with the <a href=\"https:\/\/www.gov.uk\/government\/organisations\/charity-commission\" target=\"_blank\" rel=\"noreferrer noopener\">Charity Commission<\/a> if their annual income tips over \u00a35,000 (for Scotland, it\u2019s the <a href=\"https:\/\/www.oscr.org.uk\/\" target=\"_blank\" rel=\"noreferrer noopener\">Scottish Charity Regulator OSCR<\/a>).<\/p>\n\n\n\n<p>Social enterprises are set up as businesses and so are registered at <a href=\"https:\/\/www.gov.uk\/government\/organisations\/companies-house\" target=\"_blank\" rel=\"noreferrer noopener\">Companies House<\/a>.<\/p>\n\n\n\n<p><strong>Regulation<\/strong><\/p>\n\n\n\n<p>All Charities are subject to charity law, as set out by the High Court. They\u2019re regulated by either the Charity Commission or OSCR, and, for those set up as charitable companies, also by Companies House.<\/p>\n\n\n\n<p>Social enterprises aren\u2019t charities, even if they have charitable aims or work closely with charities. They\u2019re solely regulated by Companies House.<\/p>\n\n\n\n<p><strong>Structure and leadership<\/strong><\/p>\n\n\n\n<p>Charities come in all shapes and sizes \u2013 with most of them structured depending on what they do and what benefits they\u2019d like to access. Setting up as a Charitable Incorporated Organisation (CIO), for example, means your key decision makers \u2013 your board of trustees \u2013 won\u2019t be held personally liable if your charity\u2019s finances come into question.<\/p>\n\n\n\n<p>A social enterprise can be structured as a limited company, a co-operative, a sole trader, or a business partnership, among others. They tend to be led by their directors and so are well-placed to make quick decisions.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Red tape and hoops to jump<\/h2>\n\n\n\n<p>Both charities and social enterprises are accountable for what they do. They must be seen as acting lawfully and in good faith. If they don\u2019t \u2013 by breaking the law or breaching their mission statement \u2013 they can be investigated and, ultimately, prosecuted or fined. Putting a quick stop to any payoff for all that good work.<\/p>\n\n\n\n<p>Charities, especially, are legally bound to their constitution (or &#8216;<a href=\"https:\/\/www.gov.uk\/guidance\/how-to-write-your-charitys-governing-document?step-by-step-nav=3dd66b86-ce29-4f31-bfa2-a5a18b877f11\" target=\"_blank\" rel=\"noreferrer noopener\">governing document<\/a>&#8216;), which sets out their <a href=\"https:\/\/www.gov.uk\/guidance\/how-to-write-charitable-purposes\" target=\"_blank\" rel=\"noreferrer noopener\">purpose<\/a> and how they should be structured and run.<\/p>\n\n\n\n<p>Social enterprises have fewer hoops to jump through. But you do have to be clear about your social mission. You have to be able to prove your profits are being used ethically. And you should make sure your business is run in an environmentally sustainable way.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Companies with a conscience<\/h2>\n\n\n\n<p>Both charities and social enterprises have the same duty of care towards their volunteer staff and employees. This means hiring them appropriately and under contract, providing them with adequate training and facilities, and taking responsibility for their health and safety.<\/p>\n\n\n\n<p>Both have a duty to protect their donor and customers\u2019 data. And to deliver services (if that\u2019s what they do) that are of a sufficient standard.<\/p>\n\n\n\n<p>Having the right <a href=\"https:\/\/www.policybee.co.uk\/charity-insurance\" target=\"_blank\" rel=\"noreferrer noopener\">charity and not-for-profit insurance<\/a> helps both charities and social enterprises out. It protects your people and your assets from the kind of damage that could put a stop to all your activities.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What insurance do charities and social enterprises need?<\/h2>\n\n\n\n<p><a href=\"https:\/\/www.policybee.co.uk\/trustee-indemnity-insurance\" target=\"_blank\" rel=\"noreferrer noopener\">Trustee insurance<\/a> protects the people who are legally responsible for your organisation\u2019s activities from being personally liable if something goes wrong. It extends to officers, governors, directors, and committee members, and so is suitable for both charities and social enterprises.<\/p>\n\n\n\n<p>Both charities and social enterprises need <a href=\"https:\/\/www.policybee.co.uk\/employers-liability-insurance\" target=\"_blank\" rel=\"noreferrer noopener\">employers\u2019 liability insurance<\/a> if they hire anyone. It\u2019s a legal requirement and carries heavy fines for those who don\u2019t have it (to the tune of \u00a32,500 per day). It covers your employees as well as your volunteers. <\/p>\n\n\n\n<p>Thanks to the digital age we live in, <a href=\"https:\/\/www.policybee.co.uk\/charity-cyber-liability-insurance\" target=\"_blank\" rel=\"noreferrer noopener\">cyber insurance<\/a> is vital for both charities and social enterprises. Both organisations tend to hold large amounts of donor or customer data. <a href=\"https:\/\/www.policybee.co.uk\/blog\/how-charity-cyber-insurance-can-help-charities-fight-cybercrime\" target=\"_blank\" rel=\"noreferrer noopener\">Cyber insurance helps you get back on your feet<\/a> quickly. It works to restore the damage if your data\u2019s stolen or held to ransom in a cyber-attack.<\/p>\n\n\n\n<p>Last but not least, if you\u2019re holding fundraisers, have clients visit your office, or do any kind of community work, you need <a href=\"https:\/\/www.policybee.co.uk\/public-liability-for-charities\" target=\"_blank\" rel=\"noreferrer noopener\">public liability insurance<\/a>.
