And it would seem, there are plenty of you out there offering a solution &#8211; Botox injections. All well and good.<\/p>\n\n\n\n<p>But do you know how important it is to get your Botox consent form right?<\/p>\n\n\n\n<p>What you do <em>before<\/em> giving someone Botox is just as important as what you do during the treatment itself. And here\u2019s why\u2026<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Legal point of view<\/strong><\/h2>\n\n\n\n<p>On a basic level, giving someone a treatment without getting their consent could actually be considered <a href=\"https:\/\/www.sentencingcouncil.org.uk\/news\/item\/assault-offences-explained\/\" target=\"_blank\" rel=\"noreferrer noopener\">assault<\/a>. That would mean facing a criminal conviction.<\/p>\n\n\n\n<p>And just getting consent alone isn\u2019t enough. It\u2019s got to be what\u2019s called &#8216;<a href=\"https:\/\/www.nhs.uk\/conditions\/consent-to-treatment\/\" target=\"_blank\" rel=\"noreferrer noopener\">informed consent<\/a>&#8216;. That means the client has to have all the information about what could go wrong. Warts \u2018n all. <\/p>\n\n\n\n<p>If you don\u2019t explain everything to them, and document that you\u2019ve done so, you can be sued for <a href=\"https:\/\/www.policybee.co.uk\/blog\/what-does-negligence-mean\" target=\"_blank\" rel=\"noreferrer noopener\">negligence<\/a>. That\u2019s why insurers want to know you\u2019re doing thorough consultations and consent forms, and keeping detailed client records, before they\u2019ll agree to insure you.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.policybee.co.uk\/blog\/can-anyone-train-to-give-botox-uk\" target=\"_blank\" rel=\"noreferrer noopener\">Botox has to be prescribed by a medical professional<\/a>. But it doesn\u2019t have to be administered by one. If you\u2019re a beautician qualified in injectables, and you\u2019re getting your Botox prescribed by someone else, it\u2019s important you understand the rules and laws around this.<\/p>\n\n\n\n<p>The prescriber has overriding responsibility for the safety of your clients, as explained by the <a href=\"https:\/\/www.jccp.org.uk\/uploads\/PrescribingStatementRevisedFinal_ARcomments.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Joint Council for Cosmetic Practitioners<\/a> (JCCP). So you owe it to them to get everything right when it comes to consent forms and client records. It\u2019s not just your neck on the line if things go wrong.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What should you include in a Botox and filler consent form?<\/strong><\/h2>\n\n\n\n<p>You can find lots of <a href=\"https:\/\/facesconsent.com\/consent-forms\" target=\"_blank\" rel=\"noreferrer noopener\">templates for consent forms<\/a> online, and they\u2019re a great place to start. Make sure the form is clear and concise. If your clients don\u2019t understand what they\u2019re reading, how will they know what they\u2019re signing up for?<\/p>\n\n\n\n<p>Here\u2019s what you need to include in your Botox consent form:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Details of possible side effects and complications.<\/strong> This is a big one. Don\u2019t be tempted to leave out things that could potentially put them off. Even if there\u2019s only a 1-2% chance of something happening. They need to know the whole truth to make an informed decision.<\/li>\n\n\n\n<li><strong>Client information and medical history.<\/strong> As well as their basic details, get a full medical history. This will allow you to assess whether it\u2019s safe for them to go through with the procedure. Remember that mental health is just as important as physical health.<\/li>\n\n\n\n<li><strong>How Botox works and what to expect.<\/strong> Explain in plain language how botulinum toxin works, what will happen during the procedure, and any sensations they may feel. Using pictures and diagrams can be a good way to show what you\u2019re talking about in a simple and effective way.<\/li>\n\n\n\n<li><strong>Aftercare.<\/strong> Go into detail about what the client should do after the procedure, and how to make the Botox last as long as possible. Make sure it\u2019s the right time for them \u2013 what are their plans after the procedure? Will they be able to take good care of themselves?<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>It\u2019s all in the detail<\/strong><\/h2>\n\n\n\n<p>When it comes to cosmetic procedures like Botox and dermal fillers, the more detail you can record, the better.<\/p>\n\n\n\n<p>Most professional bodies advise a two-part consent process. This means having an initial face-to-face consultation and then giving the client a \u2018cooling-off\u2019 period before coming back to sign their Botox consent form. This gives them time to digest all the information you\u2019ve given them and decide if they really want to go through with the procedure.<\/p>\n\n\n\n<p>Get to know your clients. Assess their reasoning for having the treatment. What are their expectations? Are they having it for the right reasons? Will you be able to achieve the desired outcome?<\/p>\n\n\n\n<p>Look at what cosmetic procedures they\u2019ve had in the past and get their opinion on the outcomes of those procedures.<\/p>\n\n\n\n<p>If you don\u2019t think they\u2019re the right fit for the treatment, you should say so. As difficult as that might be. You\u2019ll be protecting yourself, and them, in the long run.<\/p>\n\n\n\n<p>Treat them on an individual basis. A side-effect that might not seem like a big deal to one person could be really important to another, depending on their lifestyle. That\u2019s why they need to know about all of them.<\/p>\n\n\n\n<p>Allow them to ask questions. If they\u2019re concerned about a particular aspect of the treatment, talk about it in as much detail as possible.<\/p>\n\n\n\n<p>Document any conversations you\u2019ve had with your clients. And make sure you take before and after photos, too. Your insurer will want to see these if a claim\u2019s made against you. Keep everything together along with the consent form and be sure to hold on to all of it for a minimum of ten years.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What can go wrong<\/strong><\/h2>\n\n\n\n<p>When you\u2019re good at what you do, it\u2019s easy to get complacent. But the thing with Botox and fillers is that when it does go wrong, it can have catastrophic consequences for both the client and you.<\/p>\n\n\n\n<p>Especially if you haven\u2019t put in the groundwork by having the right consent forms in place prior to carrying out the Botox and filler treatment\u2026\u2026<\/p>\n\n\n\n<p>Worst case, a client could react badly to the botulinum toxin or filler and be left with permanent damage. If they claim you didn\u2019t warn them sufficiently about these possible side effects, or you didn\u2019t check their medical history properly, it could spell big trouble. Due diligence is super important.<\/p>\n\n\n\n<p>Or a client could claim you\u2019ve not achieved what they\u2019ve asked for. If you haven\u2019t talked to the client in detail about their expectations beforehand, you could be in for a lengthy battle. So, it pays to find all this out during a consultation.<\/p>\n\n\n\n<p>Either way, if they make a claim against you, defending yourself can not only be expensive, but disastrous for your reputation.<\/p>\n\n\n\n<p>If your client records aren\u2019t up to scratch, you could face some pretty tough lines of questioning. It could even mean not being allowed to perform cosmetic procedures in the future.<\/p>\n\n\n\n<p>That\u2019s why it\u2019s vital to document as much as possible for every client. The more informed you both are, the better the outcome, and the less likely you are to be faced with a claim in the first place. Should it come to blows, at least you\u2019ll know you have all the relevant information to prove that the client gave informed consent and that you acted professionally.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How insurance helps<\/strong><\/h2>\n\n\n\n<p>So, aesthetic claims like this can be really complicated. And yes, that means expensive. Unless you have very deep pockets and legal know-how, you\u2019ll soon come unstuck without insurance. Even if you\u2019ve done nothing wrong.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.policybee.co.uk\/botox-dermal-filler-insurance\" target=\"_blank\" rel=\"noreferrer noopener\">Botox and dermal fillers insurance<\/a> is there to protect you, and your clients, if you make a mistake in your work or hurt someone unintentionally. It\u2019ll cover all your legal costs as well as any compensation you owe.<\/p>\n\n\n\n<p>It\u2019s important you adhere to the <a href=\"https:\/\/www.policybee.co.uk\/blog\/getting-your-aesthetics-insurance-claim-paid\" target=\"_blank\" rel=\"noreferrer noopener\">terms and conditions of your aesthetics insurance<\/a> policy. Otherwise, there\u2019s a danger of your insurer not paying out if there\u2019s a claim. They\u2019ll want to see evidence that you\u2019ve used an appropriate Botox consent form and followed the rules.<\/p>\n\n\n\n<p>Having insurance also signals to your clients that you have a duty of care and that you\u2019re a responsible qualified practitioner.
