\u2018Tweakments\u2019 are ever on the rise<\/a>. Which, in an industry as notoriously self-regulated as the UK aesthetics one, has the potential to play fast and loose with public safety.<\/p>\n\n\n\n

While no aesthetician worth their salt would intentionally put their client in harm\u2019s way, botched treatments do happen<\/a>. And when they do, they can have serious consequences for your business.  <\/p>\n\n\n\n

So, it\u2019s important to take care. Because the time when regulators raise the bar for aesthetics and cosmetic practitioners might come around sooner than anyone thinks. <\/p>\n\n\n\n

With that in mind, here\u2019s our guide to the current regulations, government guidelines, and laws for aesthetics in the UK\u2026and what any new regulations might look like.<\/p>\n\n\n\n

<\/p>\n\n\n\n

What\u2019s in store for the UK aesthetics industry in 2025?<\/strong><\/h2>\n\n\n\n

First, let\u2019s take a look at some of the current trends and predictions for the UK aesthetics industry. <\/p>\n\n\n\n

Artificial intelligence should continue to fuel efficiency and innovation. This includes the development of platforms like Renude<\/a>, where real-life experts use AI technology to deliver personalised skin care advice.<\/p>\n\n\n\n

The non-invasive treatments market is valued at over \u00a311.49 billion globally<\/a>, this is expected to continue to grow rapidly in the near future.<\/p>\n\n\n\n

This growth might be impacted in the UK, though, with Scotland launching a public consultation in December 2024<\/a>. They want to bring in tougher regulations for the non-surgical cosmetic industry.<\/p>\n\n\n\n

Although the frequency of extreme weather across the globe could also mean more customers seek out collagen-stimulating procedures like hybrid dermal fillers and ultrasound treatments \u2013 favouring rejuvenation over anti-aging, and sustainability over dramatic, short-term results.<\/p>\n\n\n\n

<\/p>\n\n\n\n

What are the government guidelines for carrying out aesthetics treatments in the UK?<\/strong><\/h2>\n\n\n\n

By all accounts, including a government-commissioned review of the UK aesthetics industry<\/a>, which was carried out in 2023, it\u2019s a fragmented picture.<\/p>\n\n\n\n

Currently, the UK\u2019s laws and regulations for aesthetics focus on two main areas: the supply of prescription-only drugs (including botulinum toxin AKA Botox) via a prescribing medical professional and on the safety of work premises<\/a>.<\/p>\n\n\n\n

This means that the bulk of regulatory scrutiny is directed at registered medics, rather than on unlicensed beauty practitioners.<\/p>\n\n\n\n

What\u2019s more, there are currently no<\/strong> legal requirements for administering non-surgical aesthetic treatments in the UK.<\/p>\n\n\n\n

That means that while you\u2019d need a prescribing medic present at each pre-treatment consultation with your clients to issue a prescription-only drug in the first place, you don\u2019t need to carry an aesthetics license to administer Botox, lip fillers, vitamin\/hay fever injections, or any other non-surgical treatment. And while appropriate training and qualifications are strongly recommended by governing bodies like Save Face<\/a>, they\u2019re not yet legally required.<\/p>\n\n\n\n

This could be changing in the near future, though, especially if you live in Scotland. Following their public consultation, stricter laws could come into force as early as 2025, with a focus on improving the conditions and regulations within the industry.<\/p>\n\n\n\n

<\/p>\n\n\n\n

Putting people before practice<\/strong><\/h2>\n\n\n\n

The absence of a solid legal framework within the UK\u2019s aesthetics industry, however, doesn\u2019t mean governing bodies don’t outline what qualifications you’d need to start a practice<\/a>. Or that practitioners shouldn\u2019t exercise extreme caution.<\/p>\n\n\n\n

If you\u2019re a non-medically trained practitioner who administers Botox or filler injections in your own living room, or travels to your client\u2019s office, you’ll need to take care. If your local authority finds that your premises don’t meet their standards, you could get investigated by their Environment Health Officers, shut down, and even prosecuted.<\/p>\n\n\n\n

But that\u2019s the extreme. Currently, there are <\/a>at least 3,924 medical aesthetic clinics in the UK<\/a>. Most (if not all) are adequately insured and qualified to carry out treatments safely.<\/p>\n\n\n\n

<\/p>\n\n\n\n

Keeping pace with regulatory changes<\/strong><\/h2>\n\n\n\n

For your aesthetics clinic to be 100% reputable and above board, knowing about safe practice is a must. Training is part of that. But so is practicing effective risk management, such as taking before and after photos, getting signed consent forms<\/a> from all your clients, and having the appropriate aesthetics insurance<\/a>.<\/p>\n\n\n\n

Looking ahead to what new aesthetics regulations might be around the corner can\u2019t hurt either. It means that when legislative change does arrive in the UK, you\u2019ll be ready to hit the ground running.<\/p>\n\n\n\n

<\/p>\n\n\n\n

When will the new regulations for aesthetics businesses be introduced?<\/strong><\/h2>\n\n\n\n

In 2021, the aesthetics industry was called a \u2018wild west industry\u2019 by MPs<\/a>. Since then, there have been promising signs that new aesthetics regulations will be introduced to the UK sooner rather than later.<\/p>\n\n\n\n

Currently, only a small number of local authorities (including ones in London, Birmingham, and Essex) operate their own cosmetics licensing schemes. However, these vary in the number and type of treatments they cover.<\/p>\n\n\n\n

In 2022, an amendment to the Health and Care Bill<\/a> gave the health secretary power to introduce a national licensing scheme for practitioners carrying out non-surgical treatments in the UK. <\/p>\n\n\n\n

While most governing bodies have already submitted their recommendations, no timeline has been set just yet. However, it might mean the introduction of a \u2018traffic light\u2019 system which categorises all cosmetic procedures according to risk.<\/p>\n\n\n\n

It may also mean aestheticians will have to carry two licences, a personal and a premises one.<\/p>\n\n\n\n

Delays in the UK are probably due to the new Labour government wanting to carefully review their position before committing to plans that were proposed under the previous Conservative government. No doubt they\u2019ll be watching Scotland\u2019s progress closely.<\/p>\n\n\n\n

If you currently operate in Scotland, it\u2019d be advisable to prepare for new regs in 2025. For businesses in the rest of the UK, it\u2019s worth watching our northern neighbour closely. If the Scottish system is implemented and performs well, regulation in the rest of the UK probably won\u2019t be too far behind.<\/p>\n\n\n\n

<\/p>\n\n\n\n

What will the UK\u2019s new aesthetics regulations look like for practitioners?<\/strong><\/h2>\n\n\n\n

Currently, it\u2019s hard to know what the new rules and regulations for aesthetics might look like. Although, based on recommendations from governing bodies, we can see what a new licensing scheme could look like<\/a>. <\/p>\n\n\n\n

Assuming the government goes ahead with a \u2018traffic light\u2019 system, it\u2019s likely that carrying a credible healthcare qualification will remain an essential requirement for medics carrying out high-risk (or \u2018red\u2019) procedures like thread lifting or hair restoration surgery. On the non-surgical cosmetics side, \u2018amber\u2019 practitioners who administer Botox and dermal filler injections may need to be licensed and <\/em>supervised by a healthcare professional when administering a treatment.<\/p>\n\n\n\n

Standards should be set for low-risk (or \u2018green\u2019) procedures like micro needling, too. Aestheticians practicing these might<\/em> be allowed to do so unsupervised. However, they\u2019ll still need to meet certain hygiene and safety standards to ensure their clinic gets its licence to practice.<\/p>\n\n\n\n

For a less speculative idea of future regulations, it\u2019s a good idea to take a close look at Scotland\u2019s proposed regulations<\/a>.<\/p>\n\n\n\n

In a nutshell, their potential rules include a three-tier system. Every non-surgical cosmetic procedure would be given a tier. Each tier has different requirements, ranging from requiring a registered health professional to oversee the procedure, to the procedure only being able to be undertaken at a Healthcare Improvement Scotland (HIS)-regulated facility.<\/p>\n\n\n\n

If these regulations are a success, expect the English government to adopt a similar approach.<\/p>\n\n\n\n

<\/p>\n\n\n\n

Who regulates the aesthetics industry in the UK?<\/strong><\/h2>\n\n\n\n

Governing bodies like Save Face and the Joint Council for Cosmetic Practitioners<\/a> (JCCP) have worked hard to campaign for more regulation<\/a> in the UK aesthetics industry.<\/p>\n\n\n\n

In addition, each regulatory body sets its own rules as a condition of membership.<\/p>\n\n\n\n

For medics, the General Medical Council<\/a> (GMC), General Dental Council<\/a> (GDC), and the Nursing and Midwifery Council<\/a> (NMC) can sanction any member who doesn\u2019t comply. Falling foul of the regulations could result in you losing your licence and being struck off their register.<\/p>\n\n\n\n

Standard regulations include making sure there\u2019s a prescribing medic at client pre-consultations for treatments like Botox. As well as having professional indemnity insurance (for example, medical malpractice insurance) that covers the full scope of your practice.<\/p>\n\n\n\n

For non-medics, the governing bodies include the British Association of Beauty Therapy and Cosmetology<\/a> (BABTAC), the Hair and Beauty Industry Authority<\/a> (Habia), the National Hairdressing and Beauty Federation<\/a> (NHBF), and the UK Spa Association<\/a> (UKSA).<\/p>\n\n\n\n

These organisations set their own standards and are likely to recommend treatment liability insurance to their members. Many offer their own insurance schemes although it\u2019s worth looking at what a broker can offer too.<\/p>\n\n\n\n

<\/p>\n\n\n\n

Will the UK\u2019s new aesthetics regulations include any insurance requirements?<\/strong><\/h2>\n\n\n\n

At the very least, you might be required to have some form of indemnity insurance. These are usually referred to as \u2018medical malpractice insurance\u2019 or \u2018treatment liability insurance\u2019 (depending on whether you\u2019re a medic or non-medic). <\/p>\n\n\n\n

Whichever camp you fall into, malpractice insurance<\/a> covers your aesthetics practice for bodily injury, illness, or death of clients caused by your negligence. It pays for a lawyer to defend you from claims, sorts out any legal costs, and covers any compensation you might owe to your client.<\/p>\n\n\n\n

Other types of aesthetics insurance include public liability<\/a> and employers\u2019 liability<\/a> (this last one’s legally required if you have employees).<\/p>\n\n\n\n

Having aesthetics insurance shouldn\u2019t be an exercise in box-ticking, however. A botched treatment for Botox or fillers could see you paying out \u00a3tens of thousands of pounds in legal fees and compensation to your client. Not to mention the irreversible damage caused to your reputation.<\/p>\n\n\n\n
