While EL is a legal requirement,&nbsp;there\u2019s&nbsp;a lot more to it than that.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on how you work and who you work with, you may not&nbsp;be required&nbsp;to have it.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not to mention how much cover you need if you do. And what happens if&nbsp;you\u2019re&nbsp;caught without it when you should have it.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Don\u2019t&nbsp;worry,&nbsp;we\u2019re&nbsp;going to cover all the ins and outs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Why is employers&#8217; liability insurance a legal requirement?<\/strong>\u00a0<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">EL became a legal requirement in 1969 with the&nbsp;<a href=\"https:\/\/www.hse.gov.uk\/PUBNS\/hse40.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Employers\u2019 Liability (Compulsory Insurance) Act<\/a>.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the time, the government was facing pressure from employees.&nbsp;Many had been awarded compensation at court after being injured or falling ill at&nbsp;work. But not actually received any money because their employer&nbsp;couldn\u2019t&nbsp;afford it.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On top of that, employers were unhappy because the cost of compensation&nbsp;was pushing them into bankruptcy.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The solution was to make EL mandatory for&nbsp;almost all&nbsp;businesses with employees.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new law also:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Set minimum cover amounts to make sure businesses were properly protected.&nbsp;<\/li>\n\n\n\n<li>Required that employers display their insurance certificate somewhere employees can see it.&nbsp;<\/li>\n\n\n\n<li>Standardised what EL covers (we\u2019ll&nbsp;go into this more in the&nbsp;next section).&nbsp;<\/li>\n\n\n\n<li>Created a list of authorised insurers to make sure businesses&nbsp;don\u2019t&nbsp;get conned.&nbsp;<\/li>\n\n\n\n<li>Set out a list of exemptions (businesses that&nbsp;don\u2019t&nbsp;need to have EL). Including certain public bodies, businesses that only employ close family members etc.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What is employers\u2019 liability insurance?<\/strong>&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">So, we know why EL is mandatory and that it protects businesses and their employees. But how does it do that?&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a nutshell, it protects your business if an employee, or former employee, claims they were injured or became ill because of their work.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It covers the costs of investigating and defending against a claim. Including your legal fees.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It also pays any compensation you might&nbsp;owe, if&nbsp;you\u2019re&nbsp;found to be at fault.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Without EL,&nbsp;you\u2019d&nbsp;have to fund all this yourself. When legal, defence, and compensation costs can easily rise into multiple millions of pounds,&nbsp;it\u2019s&nbsp;easy to see why&nbsp;it\u2019s&nbsp;become mandatory to have EL in the UK.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What happens if I&nbsp;don\u2019t&nbsp;have employers\u2019 liability insurance?<\/strong>&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">First,&nbsp;it\u2019s&nbsp;important to say not every business needs to have EL. You can find all the exemptions in the&nbsp;<a href=\"https:\/\/www.hse.gov.uk\/PUBNS\/hse40.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Health and Safety Executive (HSE)&nbsp;guide<\/a>.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you&nbsp;don\u2019t&nbsp;have it when you should have, though, you could be faced with a hefty fine. Or even prosecution, depending on the circumstances.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You can be&nbsp;<a href=\"https:\/\/www.gov.uk\/employers-liability-insurance\" target=\"_blank\" rel=\"noreferrer noopener\">fined up to \u00a32,500 for&nbsp;<strong>each day<\/strong>&nbsp;you\u2019re uninsured<\/a>.&nbsp;That\u2019s&nbsp;why&nbsp;it\u2019s&nbsp;so important that you have EL in place as soon as you become an employer.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There\u2019s&nbsp;also a fine of up to \u00a31,000 for not properly displaying your EL insurance certificate. Remember, it&nbsp;must&nbsp;be somewhere your employees can easily access or see it.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A prominent place in the office, on your company intranet in an easy to find location, signposted in your&nbsp;employee handbook&#8230;&nbsp;anywhere that makes it easy for your team to find it.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The HSE actively investigates breaches of EL law.&nbsp;Here\u2019s&nbsp;an&nbsp;<a href=\"https:\/\/press.hse.gov.uk\/2026\/04\/27\/company-fined-for-not-having-compulsory-insurance-for-its-workers\/\" target=\"_blank\" rel=\"noreferrer noopener\">example of a company in Cheshire that was fined over \u00a33,000<\/a>&nbsp;in 2026 for not having the right cover in place.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How much employers\u2019 liability cover do I need?<\/strong>&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Currently, the law requires that employers have a minimum of \u00a35&nbsp;million&nbsp;of EL cover from an authorised insurer.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In practice, most insurers&nbsp;won\u2019t&nbsp;offer less than \u00a310 million.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Why? Serious claims can be expensive.&nbsp;It\u2019s&nbsp;common for them to cost more than \u00a35 million, so insurers have decided to offer more by default.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some businesses may&nbsp;require&nbsp;more cover, but&nbsp;it\u2019s&nbsp;rare. But&nbsp;there\u2019s&nbsp;a good reason for it.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It&nbsp;doesn\u2019t&nbsp;only protect your business from the financial hardship of legal costs and compensation. It also make sure your employees are properly compensated if they have an accident or fall ill at work.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although it can be confusing to know&nbsp;whether or not&nbsp;you need it.
