It says you\u2019ve used their pictures without the appropriate licenses and now you owe them a couple of thousand pounds, thanks very much.<\/p>\n\n\n\n<p>Crikey. OK. So what do you do now? Cough up? Ignore it? Panic?<\/p>\n\n\n\n<p>Those&#8217;ll be your first questions. It&#8217;s likely you&#8217;ll have many more:<\/p>\n\n\n\n<p>Are they serious? Have they got the right person? Can\u2019t I just take the image down? What happens if I don\u2019t pay? How much trouble am I in exactly? They can\u2019t just demand money from me can they? Do I need a solicitor? Is there help for this sort of thing?<\/p>\n\n\n\n<p>What&#8217;s clear is that you need some answers \u2013 and quickly. The payment deadline in the letter is only 14 days away \u2026<\/p>\n\n\n\n<p><strong>Dos and don\u2019ts<\/strong><\/p>\n\n\n\n<p>Fortunately (or unfortunately, depending on your point of view) we have experience of exactly this kind of situation.<\/p>\n\n\n\n<p>So, we\u2019ve distilled that experience into some useful pointers if you&#8217;re ever on the receiving end of a claim. Hopefully, most of your questions are answered here:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Don\u2019t<\/strong> ignore the letter. Despite what you read on internet forums, Getty aren\u2019t just trying it on and the claim won\u2019t go away if you don\u2019t do anything. Ignoring it makes you look wilfully dismissive (which never goes down well) and stringing it out only delays the inevitable.<\/li>\n\n\n\n<li><strong>Don\u2019t<\/strong> think taking the image(s) down is enough. It\u2019ll help put a lid on the amount Getty can claim but it won\u2019t solve the problem completely. Getty will still want compensation for the time the picture has been in the public domain up to that point.<\/li>\n\n\n\n<li><strong>Don\u2019t<\/strong> assume they won\u2019t go all the way. Again, ignore what the internet know-it-alls say because Getty won\u2019t hesitate to go to court if they\u2019re not getting what they\u2019re owed. It doesn\u2019t happen often but, rest assured, they\u2019re anything but a pushover. And they don\u2019t want to be seen as one either.<\/li>\n\n\n\n<li><strong>Don\u2019t<\/strong> rely on the \u2018ignorance is bliss\u2019 argument. Claiming you weren\u2019t aware you needed permission to use an image or images won\u2019t hold water and, ultimately, it doesn\u2019t matter anyway. Getty don\u2019t care if you knew or not and, strictly speaking, neither does the law.<\/li>\n\n\n\n<li><strong>Don\u2019t<\/strong> think they don\u2019t have a right to claim. They do because they\u2019re protecting what\u2019s rightfully theirs. Selling and licensing digital media is how they make money and they\u2019re doing what\u2019s best for their business. You\u2019d do the same wouldn\u2019t you?<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Do<\/strong> take it seriously. The fact you have a letter should be all the warning you need. Do try to make dealing with it a priority because the longer it goes on the more it\u2019ll cost.<\/li>\n\n\n\n<li><strong>Do<\/strong> go to Getty\u2019s website. Find the picture(s) in question and use their licence calculator to find out how much you owe (if they haven\u2019t already told you). If they&#8217;ve given you a loss figure, it\u2019s a good idea to get your own as a matter of course. It\u2019ll prove handy if you decide to contest the amount they\u2019re claiming.<\/li>\n\n\n\n<li><strong>Do<\/strong> assume you have to pay. If you didn\u2019t find and supply the image(s) yourself then it might be possible to make a recovery claim against the designer or subcontractor who did. But, regardless, if the letter is addressed to you, you\u2019ll have to pay up in the first instance.<\/li>\n\n\n\n<li><strong>Do <\/strong>try to negotiate. Reply to their letter promptly, telling them you didn&#8217;t realise you were infringing their rights (if you didn&#8217;t). State the amount you&#8217;ve calculated as their loss and make them an offer. If there\u2019s no movement, ask for an exact breakdown of the figure they have \u2013 theirs is likely to be higher. They\u2019re usually more flexible if you\u2019ve accepted liability and are willing to pay up.<\/li>\n\n\n\n<li><strong>Do<\/strong> get in touch with your <a href=\"https:\/\/www.policybee.co.uk\/professional-indemnity-insurance\" target=\"_blank\" rel=\"noopener noreferrer\">professional indemnity insurance<\/a> broker or insurer the moment you get the letter. Your policy should cover copyright infringement claims exactly like this \u2013 it makes sense to use your insurer\u2019s expertise and resources when it makes the most difference. Besides which, it\u2019s comforting to know you\u2019re not on your own.<\/li>\n<\/ul>\n\n\n\n<p>Although it\u2019s not going to be a pleasant experience, dealing with a Getty copyright claim needn\u2019t be the end of the world \u2013 or your business.<\/p>\n\n\n\n<p>The important thing is to deal with it quickly, limit the damage as much as possible and not let the situation get out of hand.<\/p>\n\n\n\n<p>If you still have an unanswered question or you\u2019d like to know more about protecting yourself, feel free to get in touch.
