But it&#8217;s important to remember that claims\u00a0don\u2019t\u00a0always stop just because you do.\u00a0\u00a0\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Run-off cover is there for what comes next.\u00a0It\u2019ll\u00a0protect you if a client\u00a0claims against you for your past work.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here, we&#8217;ll\u00a0break\u00a0down exactly what run-off cover is and how it works.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is run-off cover?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Run-off cover\u00a0keeps your insurance going\u00a0after\u00a0you\u2019ve\u00a0stopped\u00a0trading \u2013 whether\u00a0that\u2019s\u00a0because\u00a0you\u2019ve\u00a0retired,\u00a0switched to another career, stopped\u00a0offering a service or treatment, or shut up shop completely.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Adding on run-off cover is\u00a0especially important if\u00a0you\u2019ve\u00a0had\u00a0<a href=\"https:\/\/www.policybee.co.uk\/professional-indemnity-insurance\" target=\"_blank\" rel=\"noreferrer noopener\">professional indemnity (PI)<\/a>\u00a0or\u00a0<a href=\"https:\/\/www.policybee.co.uk\/medical-malpractice-insurance\" target=\"_blank\" rel=\"noreferrer noopener\">medical malpractice insurance<\/a>.\u00a0Both of these are\u00a0<a href=\"https:\/\/digibee14.sharepoint.com\/:w:\/r\/sites\/Marketing\/_layouts\/15\/Doc.aspx?sourcedoc=%7BD7317AFC-FF9B-4A34-A023-95C8921AB26F%7D&amp;file=260617_What%27s%20claims%20made%20insurance_blog%20review.docx&amp;action=default&amp;mobileredirect=true\" target=\"_blank\" rel=\"noreferrer noopener\">\u2018claims made\u2019\u00a0policies<\/a>. Which means\u00a0they only\u00a0cover claims\u00a0while the policy is active.\u00a0\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So&nbsp;if a policy ends and a claim comes in later?&nbsp;You\u2019re&nbsp;not covered.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Run-off cover fixes that. It protects you against claims made after&nbsp;you\u2019ve&nbsp;stopped&nbsp;working, for work you did before. Simple.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why should you think about adding run-off cover to your insurance?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Problems\u00a0with your work\u00a0don\u2019t\u00a0always show up straightaway.\u00a0And when they do, clients can still\u00a0claim. Regardless of whether\u00a0you\u2019re\u00a0still in business or not.\u00a0\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Examples&nbsp;could&nbsp;include&nbsp;some advice you&nbsp;give&nbsp;which&nbsp;later&nbsp;turns out to be wrong. Or a project&nbsp;which causes&nbsp;financial&nbsp;loss&nbsp;some&nbsp;months down the line. Or&nbsp;a&nbsp;complication&nbsp;during&nbsp;a treatment that&nbsp;causes unpleasant symptoms&nbsp;to show up later.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Without cover&nbsp;you\u2019d&nbsp;have to deal with the problem&nbsp;\u2013&nbsp;and pay for it \u2013 yourself.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who needs run-off cover?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The professions that typically\u00a0need\u00a0run-off cover\u00a0are those\u00a0offering\u00a0advice\u00a0or\u00a0a\u00a0specialist service. That includes consultants,\u00a0designers, copywriters, accountants, architects&#8230;basically, anyone\u00a0with professional indemnity insurance.\u00a0\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accountants,&nbsp;architects&nbsp;and surveyors&nbsp;might&nbsp;in fact&nbsp;find their professional body&nbsp;requires&nbsp;them to&nbsp;maintain&nbsp;run-off cover for&nbsp;a specified&nbsp;period&nbsp;after&nbsp;they\u2019ve&nbsp;retired or&nbsp;stopped&nbsp;trading.&nbsp;When you think about the kinds of&nbsp;expensive&nbsp;mistakes that&nbsp;can&nbsp;crop up&nbsp;with these professions,&nbsp;this makes&nbsp;sense.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Another group&nbsp;that&nbsp;may need&nbsp;run-off cover are medical and healthcare professionals&nbsp;(doctors, dentists, aestheticians&nbsp;etc)&nbsp;whose medical malpractice covers&nbsp;them for claims of&nbsp;physical and mental injury.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The problem here is the fact that&nbsp;treatments like injectables, laser,&nbsp;and skin treatments&nbsp;can lead to issues that&nbsp;don\u2019t&nbsp;show up&nbsp;immediately.&nbsp;Problems with scarring and pigmentation, for example,&nbsp;can crop up&nbsp;months or even years later.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then there are&nbsp;company directors&nbsp;stepping&nbsp;down&nbsp;from their&nbsp;jobs. Or&nbsp;business owners&nbsp;wanting to sell, merge,&nbsp;or close&nbsp;their business.&nbsp;For these people, run-off cover protects not just their past work, but that of&nbsp;their partners and employees too.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What are some run-off claims examples?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For an idea of how\u00a0run-off works and who might need it, here are some examples of it in action:\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The web developer<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A web developer builds a website for a client. Five years later, after the developer has closed their business, the client discovers a security flaw in their website that allows hackers to steal their customers&#8217; data. The client sues the developer for\u00a0<a href=\"https:\/\/www.policybee.co.uk\/blog\/what-does-negligence-mean\" target=\"_blank\" rel=\"noreferrer noopener\">negligence<\/a>. However,\u00a0run-off cover from the developer&#8217;s original PI insurance helps to defend the lawsuit.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The architect<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An architect designs a building.\u00a0Four years later, cracks start to appear in the building\u2019s\u00a0foundations,\u00a0and the building\u2019s\u00a0owner sues the architect for\u00a0producing\u00a0a faulty design.\u00a0The architect has since retired; fortunately, the run-off cover from their PI policy provides them with the financial backing\u00a0they\u2019d\u00a0need for their legal\u00a0defence.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The accountant<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An accountant helps their\u00a0client\u00a0fill out their tax return. Five years later, HMRC spots a discrepancy in the numbers and orders the client to pay fines and extra tax. The client claims the accountant\u2019s work was negligent. Even though the advisor has since stopped trading, their PI run-off cover is activated to deal with the claim.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The aesthetician<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An aesthetician\u00a0injects their client with lip fillers.\u00a0Six\u00a0months later, the client comes back\u00a0complaining that\u00a0the filler has migrated\u00a0from\u00a0the original injection site, creating a\u00a0lumpy and\u00a0uneven look.\u00a0The aesthetician has since\u00a0changed careers and is no longer offering treatments. Even so, the run-off cover on their medical malpractice policy\u00a0pays for\u00a0the\u00a0former\u00a0client\u2019s compensation.\u00a0\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Do you need to extend your run-off if you&#8217;re changing insurers?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A classic&nbsp;example of a gap in cover&nbsp;is&nbsp;where&nbsp;you\u2019re&nbsp;changing&nbsp;insurers&nbsp;and&nbsp;you find out too late&nbsp;that&nbsp;your&nbsp;new insurer&nbsp;won\u2019t&nbsp;cover claims for work&nbsp;done before the policy\u2019s start date.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then, if&nbsp;a claim for past work comes in after the switch,&nbsp;you\u2019re&nbsp;stuck&nbsp;paying for it yourself. Your new insurer&nbsp;won\u2019t&nbsp;cover it.&nbsp;And your old insurer&nbsp;won\u2019t&nbsp;either&nbsp;as your policy with them&nbsp;has&nbsp;ended.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To avoid&nbsp;this kind of&nbsp;sticky&nbsp;scenario,&nbsp;it\u2019s&nbsp;worth speaking to your insurer&nbsp;about run-off cover&nbsp;<em>before<\/em>&nbsp;you switch. Alternatively,&nbsp;you can check your new policy to see if it includes&nbsp;something called&nbsp;<a href=\"https:\/\/www.policybee.co.uk\/blog\/whats-retroactive-cover\" target=\"_blank\" rel=\"noreferrer noopener\">retroactive&nbsp;(or \u2018retro\u2019)&nbsp;cover<\/a>.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Retro&nbsp;can protect your past work under your new policy. However, not all policies include it \u2013 and not all match your&nbsp;previous&nbsp;cover exactly.&nbsp;You should check your&nbsp;policy schedule&nbsp;carefully&nbsp;and&nbsp;speak&nbsp;to your&nbsp;insurer if&nbsp;you\u2019re&nbsp;unsure.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How do you get run-off cover?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To get&nbsp;run-off cover, you&nbsp;<strong>must<\/strong>&nbsp;have an active professional indemnity or medical malpractice insurance policy&nbsp;<em>that&nbsp;<\/em><em>hasn\u2019t<\/em><em>&nbsp;expired yet<\/em>.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you\u2019re planning to stop trading&nbsp;anytime soon,&nbsp;you&nbsp;should&nbsp;tell your insurer as soon as possible.&nbsp;They\u2019ll&nbsp;want to know the dates of when you plan to stop working (or, if you have already, when that was).&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At your next insurance renewal, your insurer will offer you&nbsp;new&nbsp;run-off terms. They might also&nbsp;ask for details of&nbsp;work carried out between your last renewal and when you stopped trading.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your new insurance cover will continue for another year under its original terms. However,&nbsp;it&#8217;ll&nbsp;now include an amendment with your run-off date; meaning only claims for work carried out&nbsp;<em>before<\/em>&nbsp;the run-off date&nbsp;will be&nbsp;covered.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Is run-off cover expensive?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You might expect&nbsp;run-off cover&nbsp;to be&nbsp;much cheaper than&nbsp;maintaining&nbsp;a full-priced policy.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The likelihood of a claim being made against you&nbsp;<em>should<\/em>&nbsp;reduce as time passes by. Surely that means the cost of your run-off cover reduces&nbsp;in synch&nbsp;with the shrinking risks?&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That makes sense logically. But&nbsp;it\u2019s&nbsp;not always the case.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Insurers consider a range of factors when deciding how much your run-off cover should cost, including your claims history and&nbsp;the current market. Some professions, like architects and designers, might find that problems with their work are&nbsp;<em>more<\/em>&nbsp;likely to crop up later down the line.&nbsp;Their risk, in fact, increases over time.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Realistically, adding run-off to your PI&nbsp;or medical malpractice&nbsp;policy might mean you pay more or less than when you were trading. Or you might pay the same. It just depends.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Though quite frankly, if&nbsp;there\u2019s&nbsp;even a remote chance your past work might come back to bite you, having&nbsp;run-off cover is worth it.&nbsp;It\u2019s&nbsp;an&nbsp;antidote&nbsp;to the many \u00a3thousands in legal fees and compensation you might have to pay to make a claim go away.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How long should you keep run-off cover going?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Generally, and&nbsp;somewhat unhelpfully,&nbsp;there\u2019s&nbsp;no minimum or maximum length of time you&nbsp;have to&nbsp;have it.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Chartered accountants, architects, and surveyors are the exceptions. Their professional bodies will usually specify how long&nbsp;they\u2019d&nbsp;need to&nbsp;maintain&nbsp;PI run-off after they stop working. Generally,&nbsp;it\u2019s&nbsp;between two to six years.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For everyone else, it depends on what you or your business did and how likely you think it is that there could be a claim. If your contracts involved working on a bunch of low-risk projects that were unlikely to carry long-term results, then you might only want to keep your run-off cover ticking over for&nbsp;only&nbsp;a year.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It&#8217;s\u00a0worth noting that the\u00a0<a href=\"https:\/\/www.advicenow.org.uk\/guides\/time-limits-suing-someone\" target=\"_blank\" rel=\"noreferrer noopener\">limitations period<\/a>\u00a0for starting legal proceedings against someone is six years from the date of an alleged incident. Whether\u00a0that\u2019s\u00a0enough or too much for you\u00a0to keep your run-off for\u00a0is your call.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Run-off with me<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Who you buy your business insurance (and subsequently your run-off cover with) is up to you, of course.
