But first, some context.<\/p>\n\n\n\n<p>If you offer a service or give advice, we, and every other business insurance broker will tell you that you need <a href=\"https:\/\/www.policybee.co.uk\/professional-indemnity-insurance\" target=\"_blank\" rel=\"noreferrer noopener\">professional indemnity (PI) insurance<\/a>. Just in case someone sues you for <a href=\"https:\/\/www.policybee.co.uk\/blog\/what-does-negligence-mean\" target=\"_blank\" rel=\"noreferrer noopener\">negligence<\/a>.<\/p>\n\n\n\n<p>But, we&#8217;ll also tell you that proper, unequivocal professional&nbsp;negligence is actually pretty rare. It&#8217;s far more common to be <em>accused<\/em> of making a mistake when you haven&#8217;t. (Sneaky clients can try this to avoid paying your invoice.)<\/p>\n\n\n\n<p>Either way, you&#8217;re faced with having to defend yourself. Your reputation is a fragile and valuable thing and you want to protect it.<\/p>\n\n\n\n<p>Luckily, your PI insurance covers wing-and-a-prayer claims as well as bang-to-rights ones. All it takes is a quick call to your broker to get the ball rolling.<\/p>\n\n\n\n<p>It&#8217;s at this point you might hear &#8216;costs&#8217; mentioned.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What sort of costs?<\/h2>\n\n\n\n<p>The costs we&#8217;re talking about here are legal costs.<\/p>\n\n\n\n<p>Assuming you want to fight the claim, your insurer may want to appoint legal specialists or expert witnesses from outside their own team.<\/p>\n\n\n\n<p>The good thing is that professional indemnity covers these costs \u2013 regardless of whether you&#8217;re in the wrong or not. You&#8217;re not faced with a big solicitor&#8217;s bill; your insurer is.<\/p>\n\n\n\n<p>Even so, how those bills are paid affects you and your policy:<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Costs inclusive<\/h2>\n\n\n\n<p><strong>Costs inclusive<\/strong> policies, as the name suggests, include these legal costs in the overall level of cover.<\/p>\n\n\n\n<p>If your policy limit is \u00a31m, and a claim against you costs \u00a350,000 to investigate\/defend, there&#8217;s \u00a3950,000 left to compensate your client or fix what&#8217;s wrong.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Costs in addition<\/h2>\n\n\n\n<p><strong>Costs in addition<\/strong> (also called excluding costs) policies separate the legal costs from the rectification costs. They&#8217;re paid &#8216;in addition&#8217; to, not out of, the overall level of cover.<\/p>\n\n\n\n<p>So using the same example, those \u00a350,000 legal costs don&#8217;t eat into the overall level of cover. There&#8217;s still \u00a31m left to pay compensation or fix-up costs if needed.<\/p>\n\n\n\n<p>Fairly obviously, costs in addition policies are a safer bet. Solicitors aren&#8217;t cheap and you&#8217;d be surprised how quickly the bills mount up. Just be aware that this type of policy is a bit more expensive to buy in the first place.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Excess information<\/strong><\/h2>\n\n\n\n<p>Perhaps more importantly, the <a href=\"https:\/\/www.policybee.co.uk\/blog\/what-is-an-excess\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">excess<\/a> (the amount you pay towards a claim) can be costs inclusive or costs in addition too.<\/p>\n\n\n\n<p>A <strong>costs inclusive excess<\/strong> is paid by you whenever your insurer investigates\/defends a claim against you, regardless of its outcome.<\/p>\n\n\n\n<p>A <strong>costs in addition excess<\/strong> is only paid when you&#8217;re at fault and your insurer has to compensate your client. Unlike a costs inclusive excess, a costs in addition excess means a successfully defended claim shouldn&#8217;t cost you anything.<\/p>\n\n\n\n<p>Again, in addition excesses are a better, if more expensive, option.<\/p>\n\n\n\n<p>Not all insurers offer them though. It&#8217;s definitely worth checking your policy schedule (or quote details) to make sure you have what you need.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Know your limits<\/h2>\n\n\n\n<p>This brings us to&nbsp;our final&nbsp;word&nbsp;on&nbsp;<strong>inner limits<\/strong>.&nbsp;<\/p>\n\n\n\n<p>Inner limits (sometimes called &#8216;sub-limits&#8217;) are specific limitations within certain&nbsp;policies&nbsp;that are&nbsp;effectively&nbsp;a payment cap.&nbsp;Meaning, there may&nbsp;be a&nbsp;limit&nbsp;on how much your insurer&nbsp;will pay towards certain&nbsp;categories of&nbsp;claims.&nbsp;<\/p>\n\n\n\n<p>Some types of claims happen more often or cost more to fix. Inner limits help keep the cost of insurance affordable for most customers by capping those &#8216;risky&#8217; areas.<\/p>\n\n\n\n<p>For example, some PI policies come with a limit on how much the insurer will pay towards intellectual property (IP) disputes. <\/p>\n\n\n\n<p>Because IP claims, though relatively rare, cost more in legal and settlement costs, placing a cap on them means insurers can keep their insurance competitively priced. While those customers who need more cover \u2013 and are happy to pay a bit extra for it \u2013 can arrange to do so.<\/p>\n\n\n\n<p>Again,\u00a0any\u00a0details\u00a0of any limits\u00a0will be\u00a0laid out\u00a0in your policy schedule and\/or quote.
